PARTICULARS OF CLAIM

  • 1. The PLAINTIFF is SELMA YASMINE NDAVVILWA KAMATI (BORN NDUME) a major female person currently residing at House Number 127, Andimba Toivo-Ya-Toivo street, Suiderhof, Windhoek, Republic of Namibia.
  • 2. The DEFENDANT is TRIANUS PENDAPALA KAMATI a major male person with currently residing at number 32, Gous street, Pioneerspark, Windhoek Republic of Namibia.
  • 3. Both parties are domiciled within the jurisdiction of the above Honorable Court in the Republic of Namibia.
  • 4. The parties were married to each other in community of property on 10th of November 2018 at Gospel Truth Ministries Windhoek, Republic of Namibia, which marriage still subsists.
  • 5. No children were born during the marriage between the parties.
  • 6. During the subsistence of the marriage, and with irreconcilable differences to terminate the marital relationship between the parties, the Defendant and plaintiff indulged in the following conduct in that:
  • 6.1 The Defendant and the Plaintiff failed to communicate with one another;
  • 6.2 The Defendant and the plaintiff have differences in values and goals;
  • 6.3 The defendant and plaintiff were involved in physical contact and instances of infidelity;
  • 6.4 The Defendant has made the decision to separate from the Plaintiff since on or about December 2023;
  • 6.5 The Defendant informed the plaintiff of his intention to end the marriage after the plaintiff moved out to live with her family;
  • 7. The marriage has irretrievably broken down due to series of unresolved conflicts and differences that has persisted over time. Despite our best efforts to reconcile, it has become clear that we are unable to overcome these issues and move forward as married couple.
  • WHEREFORE THE PLAINTIFF PRAYS FOR THE FOLLOWING ORDERS:
  • 1. (a) A final order of divorce and failing compliance therewith; alternatively (b) An order for the restitution of conjugal rights.
  • 2. That each party retain the property they have in their possession.
  • 3. Plaintiff pays off own debts and defendant pays for own debts.
  • 4. Further and/or alternative relief.
